Welcome to the TrueHardcoreStore store. The terms “we”, “us” and “our” refer to TrueHardcoreStore – Kajetan Kloska. We operate an online store and website and provide related content, features, tools, products and services (the “Services”) to provide you with a convenient shopping experience.

TrueHardcoreStore operates on the Shopify platform, which enables us to provide the Services.

These Terms (“Terms of Service”, “Terms”) define the rules for using the Services and the rights and obligations of the Customer.

By using the Services, visiting the store website or making a purchase, you accept these Terms and our Privacy Policy [LINK]. If you do not accept the Terms, please stop using the Services.

  2. The rights of Customers and the Seller’s information obligations arise in particular from the Act of 30 May 2014 on Consumer Rights, the Polish Civil Code and other generally applicable provisions of Polish law.

Section 1 – Access and account

By agreeing to these Terms of Service, you confirm that you are of legal age in your state or region of residence and that you consent to any minor dependents using the Services on devices owned, controlled or operated by you.

In order to use the Services, including accessing or browsing our online store or purchasing any products or services offered by us, we may ask you to provide certain information, such as your e-mail address, billing, payment and shipping details. You represent and warrant that all information provided to our store is accurate, current and complete and that you have all rights necessary to provide such information.

You are solely responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You may not assign, sell, transfer or sublicense your account to any other person.

Section 2 – Our products

We have made every effort to display our products and services accurately in our online store. However, please note that product colors and appearance may differ depending on the device you use and its settings and configuration.

We do not guarantee that the appearance or quality of any products or services purchased will meet your expectations or match their presentation in our online store.

All product descriptions may be changed at any time without notice at our sole discretion. We reserve the right to withdraw any product at any time and to limit quantities of any products offered to any person, geographic region or country.

Section 3 – Orders

By placing an order, you submit an offer to purchase. TrueHardcoreStore reserves the right to accept or reject any order for any reason at its sole discretion. Your order will not be accepted until TrueHardcoreStore confirms its acceptance. Before accepting an order, we must receive and process your payment. Please review your order carefully before placing it, as TrueHardcoreStore may not honor cancellation requests after an order has been accepted. In the event that an order is rejected, modified or canceled, we will notify you using the e-mail address, billing address and/or phone number provided at the time of purchase.

Your purchases are subject to return or exchange only in accordance with our Return Policy [LINK].

You represent and warrant that you are purchasing products solely for personal use and not for commercial resale or export.

Section 3A – Right of withdrawal (returns)

  1. A Customer who is a consumer or an entrepreneur with consumer rights has the right to withdraw from a distance contract without giving any reason within 14 calendar days from the date of receipt of the Goods, in accordance with the Act of 30 May 2014 on Consumer Rights.

  2. In order to exercise the right of withdrawal, the Customer should submit a declaration of withdrawal (for example by e-mail) to:

  3. The Goods should be returned immediately, no later than 14 calendar days from the date on which the Customer informed the Seller of the withdrawal, to the following address:

  1. The above address is the Seller’s address and serves as the return and complaint address.

  2. The cost of returning the Goods due to withdrawal shall be borne by the Customer, except where the return results from a defect in the Goods or an error in order fulfillment by the Seller.

  3. The refund shall be made no later than 14 days from the date of receipt of the withdrawal declaration, however the Seller may withhold the refund until the Goods are received back or proof of return is provided.

  4. The Customer’s rights under this Section do not exclude, limit or suspend rights arising from mandatory provisions of law.

  5. Detailed return rules are set out in the Return Policy available on the Store website.

Section 3B – Complaints

  1. The Seller is obliged to deliver Goods free from defects. The Customer has the right to submit a complaint in the event of a defect or non-conformity with the contract, in accordance with the Polish Civil Code and the Act on Consumer Rights.

  2. Complaints may be submitted:

  3. The complaint should include:
    – name and surname,
    – contact details (e-mail / phone),
    – order number,
    – description of the defect and the claim.

  4. For transport damage complaints, attaching photos of the packaging and damaged Goods is recommended.

  5. Complaints are processed within 14 calendar days from receipt. The Customer will be informed of the decision by e-mail or in writing.

  6. If the complaint is accepted, the Seller will perform the appropriate remedy in accordance with the law and the Customer’s request.

  7. This complaint procedure fulfills the Seller’s information obligations under the Act on Consumer Rights.

Section 4 – Prices and payments

Prices, discounts and promotions may change without notice. The price charged is the price applicable at the time of placing the order and will be confirmed in the order confirmation e-mail. Unless expressly stated otherwise, prices do not include taxes, shipping costs, customs duties or import fees.

Prices in our online store may differ from those in physical stores or third-party websites. Promotional terms prevail over these Terms in case of conflict.

You agree to provide current, complete and accurate purchase and account information. You represent and warrant that payment card details are valid and that you are authorized to use them.

Section 5 – Shipping and delivery

We are not responsible for shipping or delivery delays. All delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs or events beyond our control. Risk and ownership pass to you upon delivery to the carrier.

Section 6 – Intellectual property

All content of the Services, including trademarks, texts, images, graphics, videos and their layout, is the property of TrueHardcoreStore or its licensors and is protected by intellectual property laws. You may use the Services only for personal, non-commercial purposes. Any unauthorized use is prohibited.

We may provide access to third-party tools “as is” and without warranties. Use of such tools is at your own risk.

We are not responsible for third-party websites or content. Accessing them is at your own risk.

Section 9 – Relationship with Shopify

TrueHardcoreStore uses Shopify technology. All sales are made directly by TrueHardcoreStore. Shopify bears no responsibility for transactions between you and TrueHardcoreStore.

Personal data is processed in accordance with our Privacy Policy [LINK] and Shopify’s Privacy Policy.

Section 11 – Feedback

You grant us a perpetual, royalty-free license to use any feedback you provide.

Section 12 – Errors and omissions

We reserve the right to correct errors and cancel orders in case of incorrect information.

You may not use the Services for unlawful purposes, violate laws, infringe intellectual property, send spam, distribute malware or interfere with security.

We may terminate your access at any time. Certain provisions survive termination.

These Terms are governed by the laws of the Republic of Poland. Disputes shall be resolved by competent Polish courts.
